Meta dodges billions in US taxes by calling its AI data centers experiments

Meta has utilized a federal research tax credit to save billions of dollars by classifying its massive AI data centers as "pilot models" and Nvidia chips as experimental materials. According to reports, the company saved $3.9 billion in 2025, significantly increasing from previous years and making it the largest beneficiary of this credit among public companies. This classification contradicts Meta's public statements regarding its serious investment in building superintelligence infrastructure, such as the Prometheus and Hyperion clusters. Although the tax credit originated from a 1981 law intended for broader scientific advancement, Meta argues its extensive R&D spending justifies the treatment. Internal SEC filings reveal that Meta’s accountants view this strategy as legally risky, leading to a substantial increase in reserves for uncertain tax positions. Despite potential challenges from the IRS, Meta likely benefits because the capital remains operational during any review process. EY, Meta’s auditor, approved the strategy and is reportedly promoting similar approaches to other firms purchasing AI chips.
